PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE PARISH RECORD KEEPER SOFTWARE ("SOFTWARE"). BY USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT INSTALL AND DO NOT USE THE SOFTWARE. 1. License The Software is licensed, not sold. This Agreement only gives you some rights to use the Software. Parish Record Keeper ("Licensor") reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the Software only as expressly permitted in this Agreement. You may copy the Software for archival purposes, provided all copies contain all the original proprietary notices for the Software. With this license, you may not modify, translate, reverse engineer, decompile or disassemble the Software. You may not create derivative works based on the Software. You may not copy the Software (except as specified above). You may not rent, lease, transfer or otherwise transfer rights to the Software. You may not remove any proprietary notices or labels on the Software. You may not publish the software on the Internet, or any other distribution media. 2. Ownership Title, ownership rights and intellectual property rights in and to the Software shall remain in the Developer. The Software is protected by international copyright treaties. 3. Developer's Fair Practice Commitment The Developer commits to adhering to fair and ethical programming practices. The Developer affirms that, to the best of his knowledge and belief, no code intentionally designed to harm, damage, or otherwise negatively impact the User's system has been included in the software. The Developer has made reasonable efforts to ensure that the software is free of malicious code and does not pose a security threat to the User's system. The user should make sure that the downloaded code or packages are signed with the developer's name (Bernhard Udelhoven). While the Developer strives to provide high-quality and safe software, the User acknowledges that no software is entirely free of defects. Therefore, the Developer shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the software. The Liability Disclaimer remains fully effective. 4. Developmental Stage Disclaimer You acknowledge that the Software is in the developmental stage and may contain errors, bugs, and other issues that could cause system failures or other problems. The Software is provided "as is" and "as available" without any warranties of any kind. Use of the Software is at your own risk. 5. Liability Disclaimer To the fullest extent permitted by law, Licensor shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if Licensor has been advised of the possibility of such damages), resulting from: (a) The use or the inability to use the Software; (b) Any bugs, errors, or inaccuracies in the Software; (c) Unauthorized access to or alteration of your transmissions or data; (d) Statements or conduct of any third party on the Software; (e) Any other matter relating to the Software. 6. Prerequisites The Software requires Microsoft Access to be installed on your computer, from version 2013 onwards. While the Software may run on Microsoft Access Runtime, this has not yet been tested and is not guaranteed. 7. Termination This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any term(s) of this Agreement. Upon termination of this Agreement, you shall cease all use of the Software and destroy all copies, full or partial, of the Software. 8. Governing Law This Agreement shall be governed by and construed in accordance with the laws of Zambia, without regard to its conflict of laws principles. 9. Entire Agreement This Agreement constitutes the entire agreement between you and Licensor with respect to the Software and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this Agreement will be binding unless in writing and signed by Licensor. 10. Feedback and Support The developer appreciates feedback on bugs and performance and may offer assistance but stands under no obligation to do so. 11.
